Contractual Terms and Conditions for Registration of Users of Services Provided by Seznam.cz

1.    Introduction

The joint-stock company Seznam.cz, a.s., with its registered seat at the address Prague 5, Radlická 3294/10, post code: 150 00, Business ID No.: 26168685, listed in the Commercial Register maintained by the Municipal Court in Prague, Section B, File No. 6493 (hereinafter the “Operator”), is the operator or a co-operator of a range of internet sites and mobile applications.

These Contractual Terms and Conditions for Registration of Users of Services Provided by the Operator (hereinafter the “Terms and Conditions”) apply to all services and mobile applications which the Operator operates or will begin to operate (hereinafter the “Services”).

2.    Description of Services

These Terms and Conditions govern the rights and obligations of the Operator and users of the Services during registration, login and logout via an internet interface or mobile application. The Terms and Conditions do not distinguish between user registration via an internet interface or a mobile application.

3.    Rights and Obligations of Contracting Parties

3.1.    For full use of the Services, a user opens a user account and uses it in compliance with these Terms and Conditions, as well as under special terms and conditions for use of the individual Services.

3.2.    User accounts are protected by a user name and password selected by the user. The user name must be entered in the form of an e-mail address.

3.3.    When registering, the user is obliged to provide certain personal data required by the Operator.

4.    User Login and Logout

4.1.    The user shall access the Services by logging in to their user account, i.e., by entering the user name and password.

4.2.    Logging in allows the user access to individual Services, provided that the user accepts the contractual terms and conditions for the relevant Services. A user account can be used across the Services, i.e., when switching between Services the user is automatically logged in and will not need to enter their login details again. For technical reasons, however, it is possible that individual Services will ask an already logged-in user for a special login or to accept special contractual terms and conditions.

4.3.    In order to log out from the Services, the user must click on the “Log Out” link or another similar link on the Services page. By logging out from any one of the Services, the user will be logged out from all Services and will not be able to use the Services in a manner that requires them to be logged in.

4.4.    After logging out, the user will be considered a so-called identified user, i.e., the user can be further identified on devices and browsers from which they have logged in to the Services, for example, by their user name, profile picture (if the user has uploaded one), or by other data provided by the user when registering or data added to their user profile, which will allow the user to conveniently log back in to the Services after entering their password. To delete identification data, the user must click on the “Forget”, “Forget User” link, or another similar link.

5.    Consequences of a Breach of User Obligations

5.1.    The Operator hereby reserves the right to delete user accounts if the user name is or may be offensive and/or contradicts good morals, law and order or rights of the Operator and/or third parties, and the Operator may do so without first requesting that the situation be remedied and without compensation. Special terms and conditions of the Services may define further rights to deletion of user accounts.

5.2.     The Operator further reserves the right to delete user accounts which violate these Terms and Conditions and/or the contractual terms and conditions of the individual Services, valid legislation, good morals, law and order, or rights of the Operator and/or third parties.

6.    Personal Data Processing

6.1.   When processing personal data, the Operator proceeds in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), Act No 110/2019 Coll., on personal data protection, Act No 111/2019 Coll., amending selected acts in relation to the adoption of the Act On the Processing of Personal Data, Act No. 480/2004 Coll., on certain services of information societies, Act No. 127/2005 Coll., on electronic communications, and other legislation governing personal data protection.

6.2.   For the purpose of User registration for the Services and for recognising a logged in or identified user, the Operator is entitled to process personal data of the user or personal data provided or entered by the user for the purpose of registration (especially addresses).

6.3.   Such personal data processing is legal because it is necessary for the performance of the contract under which the Operator provides registration for the Services and to which the user is a party as the data subject.

6.4.    In specific cases, the Operator may process personal data beyond the scope defined in Articles 6.2 and 6.3 of these Terms and Conditions for a particular purpose, which protects the legitimate interests of the Operator or third parties (such as the interest in safe functioning of a Service) pursuant to legislative requirements for personal data processing.

6.5.    If the user has provided or will provide the Operator with personal data of other natural persons, the user shall be obliged to inform these persons about the processing of their personal data in order to assure the legitimacy of such personal data processing. Otherwise, the user shall be liable to the Operator for incurred damages.

6.6.    Personal data may be submitted to a third party if it is necessary in relation to the operation of the Services; a contract shall thereby be established between the Operator and such third party.

6.7.   Further information about personal data handling is specified in the relevant section of the Operator’s website.

7.    Final Provisions

7.1.    For the provision of the Services, the specific terms and conditions of these Services shall continue to apply.  The stipulated terms and conditions of the individual Services shall prevail over these Terms and Conditions.

7.2.    The Operator hereby reserves the right to unilaterally change these Terms and Conditions within a reasonable scope, especially following legislative changes, technical changes within the Services, or changes in operational, organisational or business processes of the Operator. The Operator shall inform the user about a change via the Service interface at least 7 days before the change takes effect. The user is entitled to refuse a change to the Terms and Conditions, and to cancel their user account in such case. If the user continues to use their account after a change to the Terms and Conditions takes effect, they shall be deemed to have accepted the change.

These Terms and Conditions enter into force and effect on 25.7.2019.
