Terms and conditions for registration of users of services provided by Seznam.cz
 
1. Introduction
 
Seznam.cz, a.s., with its registered office at Prague 5 - Smíchov, Radlická 3294/10, Postal Code: 15000, ID No.: 26168685, registered in the Commercial Register maintained by the Municipal Court in Prague, Section B, Insert 6493 (hereinafter referred to as the "Operator"), is the operator or co-operator of a number of web servers and mobile applications. 
 
These terms and conditions for registration of users of services provided by the Operator (hereinafter referred to as "Terms and Conditions") shall apply to all services and mobile applications of the Operator that the Operator operates or will operate in the future (hereinafter referred to as "Services").
 
These Terms and Conditions shall also apply mutatis mutandis to the log-in and log-out of users via the Operator's log-in plug-in located on third-party services included in the Operator's partner network ("Seznam Login"). However, these Terms and Conditions do not apply to registration, log-in and log-out from third-party services as such.


2.    Description of Services
 
These Terms and Conditions govern the rights and obligations of the Operator and Users of the Operator's Services when registering, logging in and out, within the web interface or mobile application. Within the framework of the Terms and Conditions, whether the User has registered via the web interface or the mobile application is not decisive.
 

3.    Rights and obligations of the parties
 
3.1      In order to make full use of the Services, the User shall create a user account and use it subject to these Terms and Conditions as well as the specific terms and conditions of each Service.
 
3.2       The User Account consists of the User's chosen username, access password and the User's profile photo, if uploaded by the User. The User is obliged to enter the username in the form of an e-mail address or telephone number.
 
3.3      As part of the registration process, the User is obliged to provide the data required by the Operator.
 
3.4      Within the User Account, a User profile is created for each User, which includes the User's username and the User's profile photo, if uploaded by the User, and this data is visible to all users of the Services (hereinafter referred to as the "User Profile"). The User Profile also contains information about the User's activity on the individual Services, but the visibility of this information to all users of the Services may be modified or completely hidden by the User through the changes and settings function in the relevant section of the User Profile.
 
3.5      In the event that the User posts a profile photo or other photos through the User Profile or User Account, at the moment of posting of these photos, the User grants the Operator a non-exclusive, royalty-free license to use them on the Services for the period of time during which the User uses these photos within the User Profile or User Account and for the methods of use in accordance with the purpose of the Services and these Terms and Conditions.
 
3.6      The User acknowledges that the display of photographs pursuant to Article 3.5 of these Terms and Conditions is a use of a work within the meaning of Act No. 121/2000 Coll., on Copyright, on Rights Related to Copyright and on Amendments to Certain Acts (Copyright Act), as amended, and may be subject to the consent of their author or other authorised person. Therefore, the User declares that he/she is the owner of all rights to the photographs posted in the User's Profile or User Account to the extent corresponding to the purpose of the Services and these Terms and Conditions, and that no third party rights prevent the making available of such photographs on the Services. The User further represents that making such photographs available on the Services will not affect any third party rights, including but not limited to the rights of copyright holders, rights of personality protection, other third party rights, or violate any applicable and effective law. The User shall be liable to the Operator for any damage caused by the falsity of any statement made pursuant to this Article.
 
3.7.     Photos posted to a User Profile or User Account must comply with the following rules:
  • they must not violate the relevant laws of the Czech Republic;
  • they must not include erotic or sexually explicit content;
  • must not give a false impression of the User's identity (e.g. photographs falsely impersonating a famous person, etc.).
 

4.    User login and logout
 
4.1          The User logs in to the Service by logging in to the User's account, i.e. by entering the User's username and password. If the username corresponds to the User's telephone number, a one-time access password will be sent to the User by SMS message at the first or second login. The User acknowledges that the User may be charged network fees for sending this SMS message. The Operator is not responsible for the payment of such fees.
 
4.2         By logging in, the User is allowed to use individual Services, provided that the User has accepted the terms and conditions of the respective Service. The User's account is applicable across the Services, i.e. when switching between Services, the User is automatically logged in and does not need to re-enter the login data. However, for technical reasons, it is possible that individual Services may ask an already logged-in User for a special login or acceptance of special terms and conditions.
 
4.3         In order to log out of the Service, the User uses the "Log out" or other similar button or link on the Service page. By logging out of any Service, the User is logged out of all Services and is prevented from using the Services in a manner requiring a login.
 
4.4         After logging out, the User is considered to be an "identified user", i.e. within the device and browser from which the User logged in to the Service, the User can continue to be identified, for example, by his/her username, profile picture (if uploaded by the User within the User profile), or other information provided by the User during registration or added to the User profile, which allows the User to conveniently log back in to the Services after entering the access password. In order to remove the identification from the device, the User must use the "Forget" or "Forget User" or other similar button or link.
 

5.    Consequences of a breach of obligations by the User
 
5.1         The Operator reserves the right to delete User Accounts whose User ID is offensive and/or contrary to good morals or public order or infringe on the rights of the Operator and/or third parties, even without prior notice and without compensation. Special terms and conditions of the Service in question may also provide for additional authorisation to delete user accounts.
 
5.2         The Operator further reserves the right to delete User accounts of Users who violate the Terms and/or Conditions of the individual Services and/or applicable laws, good morals, public order or the rights of the Operator and/or third parties.
 

6.    Processing of personal data
 
6.1         The Operator processes personal data in accordance with Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, hereinafter referred to as the "Regulation"), Act No. 110/2019 Coll, Act No. 111/2019 Coll., amending certain acts with the adoption of the Act on the processing of personal data, Act No. 480/2004 Coll., on certain information society services, Act No. 127/2005 Coll., on electronic communications and other legislation governing the protection of personal data.
 
6.2         In order to register the User to the Services and to recognise the registered or identified User, the Operator is entitled to process the User's personal data or personal data provided or entered by the User during registration and/or completed on any of the Operator's Services. The User acknowledges that, in order to ensure the security of Users and their data, the Operator is entitled to process the User's personal data entered or completed on any Service across all Services of the Operator, for the purpose of better recognition of an already registered or identified User.
 
6.3         Such processing of personal data is lawful as it is necessary for the performance of the contract under which the Operator provides registration to the Services and to which the User, as the data subject, is a party.
 
6.4         In specific cases, the Operator may process personal data beyond the scope of Articles 6.2 and 6.3 of the Terms and Conditions according to the specific purpose for the protection of the legitimate interests of the Operator or third parties (e.g. interest in the safe operation of the Service) according to the legal requirements for the processing of personal data.
 
6.5          If the User has provided or will provide to the Operator any personal data of other natural persons, the User is obliged to inform these natural persons about the processing of personal data and thus ensure the lawfulness of the processing of personal data. Otherwise, the User shall be liable to the Operator for the damage caused.
 
6.6         The transfer of data that may be of a personal nature to a third party may occur if it is done in connection with the operation of the Services and is so provided for in a contract between the Operator and such a third party.

7.    Final provisions
 
7.1         Provision of specific services is further subject to specific terms and conditions of the Service in question.  The provisions of the terms and conditions of the individual Services shall prevail over the provisions of these Terms and Conditions.
 
7.2         The Operator reserves the right to unilaterally amend these Terms and Conditions to the extent appropriate, in particular in the event of a change in legislation, a technical change to the Services or a change in the Operator's operational, organisational or business processes. The Operator shall notify the User of the change via the Service interface at least 7 days before the change takes effect. The User has the right to refuse the change of the Terms and in such case to cancel his/her user account. If the User continues to use his/her User Account after the change of the Terms has taken effect, the User shall be deemed to have accepted the change of the Terms.
 

These Terms and Conditions are effective and valid as of 1 December 2021.
